Read the state coverage carefully

Montana runs a mandatory, uniform statewide building/energy/electrical/plumbing/mechanical code set adopted by the Dept. of Labor & Industry's Building Codes Bureau (ARM Title 24, ch. 301). Cities/counties/towns MAY adopt and locally enforce their own certified building code program, but by statute (MCA 50-60-301) a local code may NOT be more stringent than the state code — so there is no true home-rule variation in substantive code content, only in who does the enforcing. Where a local government has not adopted/certified a program, the state code applies directly and the state enforces it. Fire code is adopted separately by the Dept. of Justice / Division of Criminal Investigation, Fire Prevention and Investigations Bureau, and is statewide.

Authority: Montana Dept. of Labor & Industry, Building Codes Bureau (building/residential/existing-building/energy/electrical/mechanical/fuel-gas/plumbing/pool-spa/WUI codes); Montana Dept. of Justice, Division of Criminal Investigation, Fire Prevention & Investigations Bureau (fire code).
